Die program is beskikbaar by ons kantore in Pretoria, of by ons goedgekeurde handelaars. Die verkoop en gekwoteerde prys van hierdie produk sluit nie gratis ondersteuning en opleiding in nie. Enige addisionele kostes vir reis en installering is onderhandelbaar met die handelaar of Software Farm wat die installasie, ondersteuning en opleiding sal doen. Al die Windows progamme kan van die Web afgelaai word. U eerste lyn van ondersteuning is die Software Farm handelaar wat u program aan u verskaf het. U volgende lyn van ondersteuning sal ons 'Help Desk' in Pretoria wees.

Opleiding

Opleiding, en her-opleiding, is vir u eie rekening. Dit is onderhandelbaar tussen u en die Software Farm handelaar, en word nie deur Software Farm voorgeskryf nie. Software Farm bied ook opleiding te Pretoria aan.

Opgraderings

Software Farm behou hom die reg voor om sonder toestemming of ooreenkoms met gebruiker, veranderings op die program, of op die dokumentasie, aan te bring. Die nuutste weergawe van die program sal altyd op die internet beskikbaar wees. Om die program op te gradeer moet u verpligte jaarlikse lisensiefooi opbetaal wees en u moet op die nuutste weergawe van SimFini, soos op 1 Maart 2010 wees.

Die lisensiefooi bied aan die gebruiker die volgende:

  • Gratis opgradering van alle Software Farm Windows programme wat tans deur die kliënt gebruik word en wel op die nuutste weergawe soos op 1 Maart 2010 is.
  • Gratis telefoniese en elektroniese (e-pos) ondersteuning.

Wat is uitgesluit:

  • Hierdie opsie sluit nuwe programme, opleiding en persoonlike ondersteuning uit.
  • Geen program sal geregistreer word as die jaarlikse lisensiefooi uitstaande is.
  • Programweergawes vroeër as 1 Maart 2010 moet eers opgradeer word na die weergawe soos op 1 Maart 2010 teen die vasgestelde fooie.

Lisensie Ooreenkoms

Hierdie is 'n wettige kontrak (Ooreenkoms) tussen u, die eindgebruiker en Software Farm (Edms) Bpk.

Nuwe programme vanaf 1 Oktober 2005

Vanaf 1 Oktober 2005 sal die jaarlikse lisensiefooi verpligtend wees met die aankoop van enige nuwe program. Deur die program se registrasiekode aan te vra en die program te registreer verklaar u, u gebonde tot hierdie lisensie ooreenkoms en onderneem u om u te hou by die bepalings hiervan. Indien u NIE met die voorwaardes van hierdie ooreenkoms saamstem nie, stuur asseblief binne 30 dae die program en meegaande dokumentasie terug na Software Farm (Edms) Bpk.

Software Farm (Edms) Bpk. verleen hiermee aan u die reg om hierdie een (1) program met twee (2) datastelle, op een (1) rekenaar te installeer en om die meegaande dokumentasie te gebruik in terme van hierdie ooreenkoms.

U mag die program op 'n netwerk installeer en meer as een datastel gebruik, op voorwaarde dat elke datastel en netwerkpunt geregistreer word by Software Farm (Edms) Bpk. Alle nuwe programme word uitgereik met twee (2) datasdtelle en een (1) netwerkpunt. Vir addisionele datastelle en netwerkpunte is daar ‘n fooi betaalbaar.

Enige persoon wat die program wil gebruik moet sy eie gelisensieerde kopie van die program by Software Farm (Edms) Bpk verkry.

Hierdie is 'n NIE-EKSKLUSIEWE en NIE-OORDRAAGBARE beperkte lisensie.

Kopiereg

Die program en dokumentasie is die eiendom van Software Farm (Edms) Bpk.

U mag die program alleenlik kopieer vir:

  1. Rugsteundoeleindes.
  2. Gebruiksdoeleindes op een (1) hardeskyf, mits u die oorspronklike media hou vir rugsteundoeleindes. U moet die kopiereg-kennisgewing op alle kopieë van die program aanbring.

U mag NIE die dokumentasie kopieer nie.

Software Farm (Edms) Bpk. behou alle regte, belang en eienaarskap van en in die program, kopieë van die program en dokumentasie. Software Farm (Edms) Bpk. behou die reg voor om die program en dokumentasie op te gradeer en te verander sonder enige kennisgewing van enige aard ookal.

Beperkings

U mag nie die program of dokumentasie uitleen, verhuur of versprei nie.

U mag die reg om die program te verkoop aan enige gewillige koper, op voorwaarde dat u die volgende vereistes nakom:

  1. Aan die koper ALLE media en dokumentasie oorhandig.
  2. U ALLE kopieë van die program en dokumentasie van u rekenaar verwyder.
  3. U Software Farm (Edms) Bpk. skriftelik in kennie stel van die naam en adresbesonderhede van die nuwe eienaar.
  4. U moet dit onder die nuwe eienaar se aandag bring dat Software Farm (Edms) Bpk. op geen manier verantwoordelik is vir ondersteuning en opleiding totdat die nuwe eienaar reëlings met Software Farm (Edms) Bpk. getref het nie.
  5. Die nuwe eienaar moet skriftelik 'n getekende kennisgewing aan Software Farm (Edms) Bpk voorsien wat meld dat hy vertroud is met die inhoud van hierdie lisensieooreenkoms en bereid is om homself hierdeur en tot die voorwaardes hiervan te verbind.

Enige afwyking van hierdie voorwaardes sal die transaksie ongeldig maak.

U mag nie die program terugontwerp ("reverse engineer"), dekompileer ("decompile") of dissekteer nie. U mag ook nie die program verander, vertaal of enige ander werke skep op grond van die program of dokumentasie nie. U onderneem om die program en dokumentasie te beskerm teen ongemagtigde publikasie, gebruik, reproduksie en/of verspreiding.

Termyn

Hierdie ooreenkoms is van krag vanaf die datum waarop dit op u rekenaar geïnstalleer is tot en met kansellasie. U mag hierdie ooreenkoms enige tyd kanselleer deur die program te vernietig, asook alle kopieë daarvan, die dokumentasie en enige ander items wat die program mag vergesel.

Hierdie ooreenkoms sal onmiddellik gekanselleer word indien u versuim om te voldoen aan die terme soos uiteengesit in hierdie ooreenkoms. Na sodanige kansellasie moet u dadelik die program en dokumentasie vernietig of terugstuur aan Software Farm (Edms) Bpk sonder vergoeding van enige aard.

Software Farm (Edms) Bpk. behou die reg voor om enige geregtelike of gelykstaande stappe te neem om sy belange te beskerm.

Waarborg

Software Farm (Edms) Bpk. waarborg die korrektheid van die fisiese media (nie die program daarop nie) onder normale gebruik vir dertig (30) dae na ontvangs van die program.

Software Farm (Edms) Bpk. maak GEEN ander waarborge van enige aard ookal, en ontken enige ander waarborge, hetsy direk of geïmpliseer. Die program en dokumentasie word voorsien "soos is" sonder enige waarborge van enige aard.

Software Farm (Edms) Bpk. waarborg nie dat die program sal voldoen aan u vereistes nie, dat die program foutloos sal werk en dat foute in die program reggestel sal word nie. U aanvaar alle verantwoordelikheid met die keuse van die program en dokumentasie om u spesifieke resultate te bereik. Indien die program of dokumentasie oneffektief vir u bewys word, is u, en nie Software Farm (Edms) Bpk. of enige handelaar of agent, verantwoordelik vir die koste vir die versiening en herstel daarvan.

Geen mondelikse of geskrewe inligting of advies gegee deur Software Farm (Edms) Bpk., sy handelaars, verspreiders of agente skep enige waarborg of verbreed hierdie waarborg nie.

Verhaling

Software Farm (Edms) Bpk. se volle verantwoordelikheid, op eie diskresie, is die:

  1. Vervanging van enige disket/CD wat nie aan hierdie waarborg voldoen nie en wat teruggestuur word aan die plek vanwaar dit gekoop is tesame met die aankoopfaktuur.
  2. Terugbetaling van die lisensiefooi om die program te mag gebruik indien Software Farm (Edms) Bpk. nie ‘n media (fisiese disket/CD) kan voorsien wat foutloos is en voldoen aan hierdie waarborg nie.

Onder geen omstandighede sal Software Farm (Edms) Bpk., of enige van sy handelaars of agente aanspreeklik wees vir enige skade wat ook al, insluitende, sonder beperking, skade gely ten opsigte van verlies van wins, staking van besigheid, verlies van data of inligting of enige direkte of indirekte, spesiale, gepaardgaande, of toevallige skade, voortspruitende uit die gebruik, of onvermoë om die program of dokumentasie te gebruik, op enige manier veroorsaak.

Onder geen omstandighede sal Software Farm (Edms) Bpk. se aanspreeklikheid, hoe gegrond ookal, die oorspronklike aankoopwaarde van die lisensie oorskry nie.

U verklaar dat u die ooreenkoms gelees het, dit verstaan en onderneem om u te hou by die terme daarvan.

Verder verklaar u dat hierdie 'n volle inklusiewe ooreenkoms is tussen u en Software Farm (Edms) Bpk, en dat hierdie ooreenkoms alle vorige ooreenkomste vervang, hetsy modelings, geskrewe of enige ander vorm van kommunikasie rakende die inhoud van hierdie ooreenkoms.

Hierdie ooreenkoms kan slegs verander word deur 'n skriftelike ooreenkoms geteken deur Software Farm (Edms) Bpk. en uself.

Installasie

Die installasie moet verkieslik deur 'n gesertifiseerde Software Farm handelaar gedoen word, waar die opstel en opleiding ook gedoen kan word. Die koste hiervan word nie deur Software Farm voorgeskryf nie en is onderhandelbaar tussen u, die gebruiker en die handelaar wat die program aan u voorsien.

Om SimFini suksesvol te installeer het u ten minste die Windows 95 bedryfstelsel nodig.

Support

Software Farm (Pty) Ltd., who developed this program, has the following policy:

The program is available at our offices in Pretoria, or at our approved dealers. The sale and quoted price of this product does not include free support and training. Any additional travel and installation cost is negotiable with the dealer or Software Farm who will do the installation, support and training. All the latest Windows programs can be downloaded from the web. Your first line of support is the Software Farm dealer that provided you with the program. Your next line of support is our “Help Desk” at our offices in Pretoria.

Training

Training and retraining is for your own account. This is negotiable between you and the Software Farm dealer, and is not prescribed by Software Farm. Software Farm also offers training in Pretoria.

Update

Software Farm retains the right to change either the program or the documentation at will, without any prior consent or agreement. The latest version will always be available on the internet. To update your SimFini the compulsory yearly licence fee must be paid in full and you must be on the version as on 1 October 2008 (SimFiniV).

This licence fee offers the user the following:

  • Free updates on all Software Farm Windows programs used by the clients, as from the versions on 1 March 2010
  • Free telephone and electronic (e-mail) support.

What is excluded:

  • This option exclude new programs, training and personal support.
  • No program will be registered if the yearly licence fee is outstanding.
  • Programs with versions earlier than the version as on 1 March 2010, must be updated to the version as on 1 March 2010, at the applicable cost.

License Agreement

This is a legal contract (Agreement) between you, the end user, and Software Farm (Pty) Ltd.

New programs as from 1 October 2005

With the sale of any new program as from 1 October 2005, the yearly licence fee will be compulsory. By requesting the registration code, and activating the program, you agree to be bound by the terms and conditions of this agreement. If you do NOT agree to these terms and conditions, return this package, and accompanying items (including all documentation) to Software Farm within 30 days.

Software Farm (Pty) Ltd grants you the right to use this one (1) computer program with two (2) data sets on a single (1) computer, and to use the accompanying documentation, whether written, or electronic, within the terms of this agreement.

You may install the program on a network and use more than one data set on condition that all data sets and network points must be registered at Software Farm (Pty) Ltd. All new programs are issued with two data sets and one network point. A fee is payable for any additional data set or network point.

Any other person wishing to use the program must obtain a licensed copy of the program from Software Farm (Pty) Ltd.

This is a NON EXCLUSIVE and NON TRANSFERABLE limited licence.

Copyright

The program and documentation are the property of Software Farm (Pty) Ltd.

You may copy the program solely for:

  1. Back-up purposes.
  2. Operating purposes on a single hard disk or other storage device, provided that you keep the original for back-up purposes. You must attach the Copyright notice on all copies of the software.

You may NOT copy the documentation.

Software Farm (Pty) Ltd retains all rights, title, interest, and ownership of, in, and to the software, copies of the software, and the documentation. Software Farm (Pty) Ltd reserves the right to modify and or update/ enhance the software, documentation without obligation to notify you of any changes, or to supply you with them.

Restrictions

You may NOT loan, rent, lease or distribute the program or documentation.

You may resell the rights to use the software to any willing buyer, on condition that you:

  1. Supply the buyer with all program media and documentation.
  2. You remove ALL versions and copies of the software from your computer as well as all documentation.
  3. You must notify Software Farm (Pty) Ltd in writing, of the new registered owner of the software.
  4. You bring to the attention of the new owner, that Software Farm (Pty) Ltd is in NO way liable to them for any support and training until arrangements have been made between them and Software Farm (Pty) Ltd.
  5. The new owner must also supply Software Farm (Pty) Ltd with a letter stating that they are prepared to be bound by the terms and conditions of this agreement.

Any deviation from these conditions will declare the transfer void.

You may NOT reverse engineer, decompile, or disassemble this software, and you may NOT modify, translate, or create any other works from the software or documentation.

You agree to protect the program and documentation from unauthorised publication, use, reproduction and/or distribution.

Term

This agreement is effective from the date you install this program on your computer, until terminated. You may terminate this agreement at any time by destroying the software, all copies of the software, the documentation and all other materials accompanying this package.

The agreement shall terminate immediately if you fail to comply with any term or condition of this agreement. Upon any termination under these circumstances, Software Farm (Pty) Ltd will retain the right to take any legal steps to protect its interest. You shall immediately destroy or return all copies of the software and documentation to Software Farm (Pty) Ltd after such a cancellation without any compensation.

Warranty

Software Farm (Pty) Ltd warrants that the physical media (meaning the diskette(s)/CD’s themselves, not the software) on which you received the software, shall be free from defects in material and workmanship under normal use for a period of thirty (30) days from the date you received the software.

Software Farm (Pty) Ltd makes NO other warranties of any kind, and hereby disclaims all other warranties, either express or implied. The software provided on the diskette(s)/CD’s and the documentation are provided "as is", without warranty of any kind.

Software Farm (Pty) Ltd does not warrant that the software or the documentation will meet your requirements, that the operation of the software will be error free, or that all defects in the software and/or documentation will be corrected. You assume sole responsibility for the selection of the software and documentation to achieve your particular goals. Should the software or documentation prove defective to you, you, and not Software Farm (Pty) Ltd or it's suppliers or agents, assume the entire cost of all necessary servicing, repair, or correction.

No oral or written information or advice given by Software Farm (Pty) Ltd, it's dealers, distributors or agents, shall create a warranty or in any way increase the scope of this warranty.

Remedies

Software Farm (Pty) Ltd’s entire liability shall be, at Software Farm (Pty) Ltd’s discretion:

  1. Replacement of any diskette(s)/CD’s which has not met this warranty and which is returned to the place of purchase with a copy of the receipt within 30 days.
  2. Refund of the price paid by you for this license to use the software and documentation if Software Farm (Pty) Ltd is unable to deliver a replacement media free of defects in material and workmanship.

In NO event shall Software Farm (Pty) Ltd, or it's dealers/agents, be liable for any damage whatsoever, including, without limitation, damages for loss of profits, business interruption, loss of data, or information, or other direct, indirect, special, consequential, or incidental damages, arising out of the use, or inability to use, the software and/or documentation, however caused.

In NO event shall Software Farm (Pty) Ltd’s liability, however founded, exceed the receipt price paid by you for this license.

You acknowledge that you have read this agreement, understand it, and agree to be bound by its terms and conditions.

Furthermore you agree that this is the whole and inclusive statement of agreement between you and Software Farm (Pty) Ltd, and that this agreement supersedes all prior agreements, whether verbal or written, and any other communications relating to the subject matter of this agreement. Only a written, signed agreement by both you and Software Farm (Pty) Ltd can modify this agreement.

Installation

The installation should preferably be done by a certified Software Farm dealer, upon which training and implementation should be done. The cost for this service is not prescribed by Software Farm, and is negotiable between the potential user and the dealer.

To install SimFini, you would need at least the Windows 95 operating system.
